The terms and conditions set out below (the ‘Conditions’) govern the Emirates corporate business rewards program (the ‘Business Rewards Program’). These Conditions should be read in conjunction with the terms and conditions on the emirates website www.Emirates.com (‘Emirates Website’).

The Business Rewards Program is offered by Emirates, a Dubai corporation established by Decree No.2 of 1985 (as amended) of the Government of Dubai and whose registered office is at Emirates Group Headquarters Building, PO Box 686, Dubai, United Arab Emirates. In these Conditions ‘we’, ‘our’ and ‘us’ refers to Emirates and ‘you’ and ‘your’ means any corporate entity or organisation participating in the Business Rewards Program.

The Business Rewards Program is a corporate loyalty rewards scheme which provides travel rewards together with an online booking and travel management system for any organisation who is a member of the Business Rewards Program (‘Member’).

Once a Member subject to these Conditions your organisation can earn corporate air miles (‘ Business Rewards Miles’) when your employees and/or any other individuals within your organisation whom you nominate (the ‘Participants’) fly with us or use services provided by other providers of goods or services participating in the Business Rewards Program including (but not limited to) other airlines, hotels and resorts, financial, leisure and lifestyle service providers and car hire companies (‘Service Partners’) a list of which can be found on the “How it Works” section of Business Rewards on Emirates.com. Once accumulated you can redeem Business Rewards Miles in return for flights or other goods and services supplied by us or the Service Partners (‘Rewards’). Business Rewards Miles for flights on Emirates can only be earned on flights booked using the Business Rewards Program online booking engine (‘Business Rewards Booking Engine’). Flight bookings made via the website www.Emirates.com under the ‘plan and book’ booking engine will not be eligible for Business Rewards Miles. Note that neither Business Rewards Miles nor Rewards have any cash value.

Membership in the Business Rewards Program (‘Membership’) is subject to these Conditions and you understand that by participating in the Business Rewards Program you agree, that your organisation and the Participants shall be bound by these Conditions.

These Conditions cannot be suspended, cancelled, modified, varied or otherwise amended without the prior written consent of Emirates. Emirates in its sole discretion, reserves the right to modify or amend these Conditions and/or the Business Rewards Program (including but not limited to amendments relating to the accrual and redemption of rewards) at any time without notice, although Emirates shall use its reasonable efforts to ensure that any changes to the Conditions will be posted here. We therefore recommend that you check the Conditions each time you visit the website.

Membership

To apply for Membership each organisation must apply online at the Business Rewards section of the Emirates Website. Application must be made by a person designated by your organisation to administer your Membership and act as your organisation’s representative (‘Program Administrator’).

The Program Administrator must complete the application process for Membership. By doing so they confirm that:

  • They have the authority to apply for Membership on your behalf
  • You accept these Conditions
  • You are located and registered in the country in which the Business Rewards Program is offered
  • Your Participants give permission for information on their business travel to be reported back to the Program Administrator (or the Additional Administrator as the case may be)

An organisation applying for Membership undertakes that it does not and will not participate in any other Emirates corporate sales incentive, discount or special rates agreement unless this has been approved in writing by Emirates.

The Program Administrator will be responsible for your participation in the Business Rewards Program and be authorised to make bookings and collect and redeem Business Rewards Miles accrued. There is no fee to become a Member of the Business Rewards Program.

Unless otherwise agreed in writing by Emirates your Membership permits you to submit a maximum of 80 Participants per year (the ‘Participant Threshold’) to the Business Rewards Program. In this case a ‘year’ will constitute 12 months from the date of your Membership and the anniversary of the same thereafter. You can only have 80 Participants at any time. If you delete Participants at any stage you will not be permitted to add alternative Participants in place of those removed you must wait until the following year for the opportunity to reach your Participant Threshold.

Participants must be approved by a Program Administrator or respond to an invitation to join from a Program Administrator. It is your responsibility to ensure that all Participants read, understand and agree to the Conditions.

Participants must be a legal adult in their country of residence and need not reside in the country where the Member is registered.

Once accepted for Membership your organisation will be given a Business Rewards Program Membership account with a unique number (‘Program Account’). The Program Administrator will also be provided with a unique login/ID and asked to submit a chosen password for the Program Account. It is the Program Administrators responsibility to restrict access to your computer to prevent unauthorised access to your Program Account. You agree to accept responsibility and liability for all activities that occur under your Program Account. You should take all necessary steps to ensure that the login/ID and password is kept confidential and secure and should inform us immediately if you have any reason to believe that the password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

The Program Administrator will be in a position to appoint one or more additional administrator who will be able to make bookings and collect and redeem Business Rewards Miles (‘Additional Administrator’). The appointment of the Program Administrator and any Additional Administrator shall be at your own risk and we shall not at any time be responsible for the misuse of your Program Account or any Rewards which are incorrectly awarded. It is your responsibility to ensure any Program Administrator and Additional Administrator adheres to these Conditions.

The Program Administrator and/or the Additional Administrator must maintain an updated organisation profile. This is updated via the Program Account on the Emirates Website

All correspondence will be sent to the Program Administrators email address (and where appropriate copied to any Additional Administrators).

You are responsible for the actions of your Program Administrator and any Additional Administrator.

An organisation may not join the Business Rewards Program if:

  • it or a party connected to it is a member of any other corporate sales incentive, discount or special rates agreement with us;
  • it is a travel agent
  • If you have a corporate agreement with emirates airlines;
  • Your organisation is located in a country where the Business Rewards Program is not available. For a list of participating countries see the “How it Works” section of Business Rewards on the Emirates Website.

Membership is always subject to our discretion. We reserve the right to refuse your application for Membership or suspend and/or cancel any existing Membership if you breach these Conditions or if you use your Membership account to conduct suspicious or fraudulent transactions.

Multiple Memberships are not permitted. A Member cannot be assigned more than one Program Account .

A Participant cannot join more than one Member’s Program Account and it is the responsibility of the Program Administrator to ensure that this does not occur. A Participant may at any time, chose to leave one Member’s Program Account and join another Member’s Program Account.

If your organisation has more than one Program Account the duplicate and/or additional accounts will not be merged and Business Rewards Miles will not be transferred or combined. Your Program Administrator will need to cancel the duplicate and/or additional accounts and ensure that your Participants are reflected in the retained Program Account.

Note we reserve the right (without notice) to review and audit your Program Account at any time to ensure your compliance with these Conditions, our Conditions of Carriage and our website Terms and Conditions and any other applicable rules and regulations. Redemption of Rewards will not be permitted during such review and audit.

Earning Business Rewards Miles

You can begin earning Business Rewards Miles as soon as your organisation is issued a Program Account.

Participants who are members of our frequent flyer rewards scheme (‘Skywards Member’) will earn Skywards air miles (‘Skywards Miles’) for all Business Rewards travel at the rate defined by Skywards. Skywards Miles will be credited to the Participants Skywards account. The Skywards Miles which can be earned can be calculated using the earnings calculator on Skywards.com. Participants will not be eligible for all promotions offered to Skywards Members Participants must check the individual terms and conditions of each Skywards promotion to check whether they are eligible. .

A Skywards Family Bonus Member is not entitled to become a Participant of the Business Rewards Program.

Business Rewards Miles will be earned for travel on Emirates airlines by your Participants (and not to any third party) according to the revenue paid for the ticket excluding taxes and surcharges on flights booked through the Business Rewards Booking Engine. Business Rewards Miles may not be purchased.

The Participant in whose name the travel is booked must actually travel in order for the Member to qualify for Business Rewards Miles.

The Business Rewards Miles credited to your Program Account will reflect the fare price excluding taxes and surcharges. Business Rewards Miles can only be accumulated once per flight per Member.

Only fares available on the Business Rewards Booking Engine qualify for Business Rewards Miles.

No Business Rewards Miles will accrue on:

any flight segment of the ticket flown on an airline other than Emirates;

  • the redemption of Rewards;
  • Reward Flights;
  • any flights taken by children, infants or unaccompanied minors;
  • flight taken by individuals who are not Participants; or
  • Flights booked by any source other than the Business Rewards Booking Engine on the Emirates Website.

No Business Rewards Miles or Skywards Miles will be earned by the Participant on Business Rewards redemption flights.

A Member may earn Business Rewards Miles using the qualifying services of Service Partners on or after the Members’ joining date and after the join date of the Service Partner.

To earn Business Rewards Miles, a Member must either produce a membership card or quote the Program Account number at the time of paying for other qualifying goods or services.

Service Partners, and the terms and conditions under which Business Rewards Miles are earned through a Service Partner, may vary from time to time. The terms and conditions concerning the accrual of Business Rewards Miles may also vary between Service Partners. It is the responsibility of the Member to verify eligibility to earn Business Rewards Miles at the time of booking.

Details of the Business Rewards Miles earned by your organisation can be viewed in your Program Account. Business Rewards Miles will usually be credited to your Program Account on the 16th day of the month after the month in which you travelled. Whilst we will endeavour to credit Business Rewards Miles within the timescales specified we will not be responsible for any delay in crediting Business Rewards Miles to your Program Account. Rewards may not be redeemed until recorded in you Program Account. If you have completed part of a journey the Business Rewards Miles will be prorated and the remaining part of the journey awarded Business Rewards Miles in the month following that flight.

Requests for retrospective Business Rewards Miles must be made within 60 business days of the date of travel on the flight which qualified for the Business Rewards Miles. We may require you to send to us proof of travel including the retained segment of the boarding pass where there is a dispute in relation to your entitlement to Business Rewards Miles.

Claims for retrospective Business Rewards Miles can only be made by completing the requisite form which can be found in the “How it Works” or ‘Help’ sections of Business Rewards on the Emirates Website . Such claims will be reviewed and where valid Business Rewards Miles will be credited to the Program Account. Disputes regarding Business Rewards Miles should be directed to Emirates Customer Affairs via email ( customer.affairs@emirates.com).

You will not be able to earn further Business Rewards Miles if:

  • you merge with, acquire or are acquired by another business in which case you must redeem your Business Rewards Miles within 3 months of your change of status; or
  • at any time you go into liquidation, receivership or administration in which case you will not be able to redeem you Business Rewards Miles

unless otherwise agreed by us in writing.

Business Rewards Miles cannot be combined with or added to any other Emirates rewards schemes or promotions personal or otherwise.

Business Rewards Miles expire 3 years from the date on which the flight was taken. Miles will removed from the account only once per year on the last day of the month which is the anniversary of the joining month.

However, we may at our sole discretion impose such time limit for the validity of the redemption of Business Rewards Miles as we deem appropriate.

Redeeming Rewards

Rewards can only be redeemed by the Program Administrator and any Additional Administrator. The Rewards may be allocated to any person designated by the Program Administrator or Additional Administrator.

Rewards are redeemed by the Program Administrator and any Additional Administrator through your Program Account.

Details of your redemption transactions will be documented in your Program Account as soon as the travel is booked. The Business Rewards Miles used will be deducted immediately on the purchase of a Reward.

Risk (for example unauthorised or fraudulent redemption) associated with Business Rewards Miles passes to you as soon as Business Rewards Miles are documented on your Program Account. Emirates is not liable for unauthorised or fraudulent use of your Program Account and/or redemptions.

Rewards or Business Rewards Miles may not be sold, bartered or purchased and any Rewards obtained in this manner will be void as will any Rewards which have been altered or if a person other than the person named on the Reward attempts to use the Rewards. Rewards which are deemed void shall result in the forfeiture of the corresponding Business Miles. Emirates may at its sole discretion terminate Membership and/or forfeit all your accumulated Business Rewards Miles to date in respect of actions which result in a void Reward.

All Rewards are subject to availability.

Rewards consisting of goods or services offered by independent suppliers shall also be subject to the relevant terms and conditions of the independent supplier. All flight schedules remain subject to change without notice.

Reward Flights

Rewards for travel on Emirates flights (‘Reward Flight’) are subject to Emirates Conditions of Carriage and Terms and Conditions and IATA fare construction rules as appropriate.

Reward Flights are purchased using Business Rewards Miles.

Reward flights are only available on services operated by Emirates Airlines. A Reward ticket cannot be endorsed to a carrier other than Emirates.

All Reward Flights are subject to availability of reward seats and can only be taken as return flights. One way reward flights are not permitted.

Reward Flights can only be booked online by a Program Administrator using the Business Rewards booking engine for reward flights.

All Reward Flights shall be issued as an electronic ticket and are subject to the usual taxes, fees, charges and surcharges associated with travel including (but not limited to) airport departure tax, customs fines, immigration fees, airport charges, customer user fees, fuel surcharges, security and insurance surcharges and all other incidental fees or taxes (the ‘Charges’) charged by any person or relevant authority or body for which you are directly liable and responsible for. Business Rewards Miles cannot be used to pay for these Charges.

Reward flights must be completed within 12 months of the date of ticket issue.

Reward Flights taken will appear on the travel activity page in the Program Account on the 17th day of month following the travel being taken.

For the avoidance of doubt Reward Flights shall not be refunded once issued. You will be liable to us for the full published fare plus reasonable costs (including legal fees) for any travel undertaken and associated with a Reward Flight deemed void as a result of your actions.

Reward Flights cannot be upgraded using Skyward Miles, cash or any other method.

Reward Flights may only be cancelled prior to travel of the first sector.

You understand that any cancellation by you will be subject to an administration fee (‘Change Fee’). The Business Rewards Miles applicable will be recredited to your Program Account, and refunds of taxes and surcharges will apply. Business Rewards Miles may be re-credited to your Program Account if a Reward Flight ticket is completely unused and valid.

After the first sector of any Reward Flight has been flown changes to the remaining sectors may be permitted provided always that such changes relate to the same routes. Any such changes remain subject to the validity of the Reward Flight ticket, the availability and capacity of the flight/route, and additional taxes and surcharges which may apply. Name changes are not permitted.

Business Rewards Miles will not be credited to your Program Account for sectors which the Participant does not fly. However part refunds of taxes and surcharges may apply (although this is at the sole discretion of Emirates). All refunds will incur a US $50 service fee (‘Service Fee’).

The Service Fee and Change Fee will be subject to change at the sole discretion of Emirates.

It is the responsibility of the Participant travelling to ensure that he/she has a valid passport, visas, health certificates and all other necessary travel documentation required for the travel undertaken. A failure to travel with the correct documentation could result in the Participant being refused travel, entry to the country of their destination or stop-over, deportation or incarceration and in such circumstance(s) you will be solely responsible for any cost, loss or damage which your travelling Participants or we (or our agents or servants) incur.

Data Protection

Emirates takes its responsibilities regarding the protection of personal information relating to individuals very seriously. Whilst you remain a Member we are likely to process personal information and data relating to your Participants, Program Administrator and Additional Administrators including (but not limited to):

· personal data such as names, addresses, contact numbers, date of birth, passport number ,payment card details and credit details;

· Membership data including transactions carried out such as redemption of Rewards;

· Data relating to travel booked or undertaken by your Participants

· immigration and customs control, safety, security, health, administrative and legal data

· information or data relating to ethnic origin, religious beliefs or medical conditions (‘sensitive data’)

· If a Participant, the Program Administrator or the Additional Administrators are members of our frequent flyer rewards scheme (‘Skywards Member’) we may also hold additional information about them, such as their personal air mile accrual and flights they have purchased by way of redemption of air miles as a Skywards Member.

· Details of your visits to our website including, but not limited to, traffic data and location data, whether this is required for our own billing purposes or otherwise and the resources that you access.

· Correspondence that you send us when you contact us.

(‘Personal Information’)

Personal Information we collect in respect of your Participants, Program Administrator and Additional Administrators may be:

· Supplied to other departments, companies, divisions of Emirates and Emirates group of companies;

· Transferred to countries outside the European Economic Area whether or not such countries have data protection laws;

· Made available to customs, immigration and/or other regulatory bodies and divisions;

· Supplied to you, and our data processors .

Personal Information will be processed for the following purposes:

· Processing your application for Membership

· Management and administration of the Business Rewards Program

· Redemption of Rewards

· Making changes to the Rewards and/or developing new Rewards

· Accounting, audit , billing and credit or other payment card verification and screening

· safety, security, crime prevention/detection

· Testing, development and maintenance of the Business Rewards Program

· Immigration and customs control

· Communicating with you, your Program Administrator, Additional Administrators or Participants

· Conducting customer satisfaction surveys, research, statistical and market analysis

· customer relations and future dealings with you

· Direct marketing

· Any other purpose which is obvious or communicated to you, your Program Administrator, Additional Administrators or Participants

You confirm you will notify in writing your Program Administrator, Additional Administrators and Participants:

· The Personal Information collected by us

· The manner in which Personal Information may be processed, used and disclosed by us

· That their Personal Information may be held for processing in countries outside the European Economic Area whether or not such countries have adequate data protection laws or regulations.

You confirm that your Program Administrator, Additional Administrators and Participants consent to our use of such Personal Information.

When making a booking on behalf of any other person(s) you agree that we may rely on the authority of the Program Administrator and Additional Administrators.

Termination

If you wish to terminate your Membership your Program Administrator must do this through your Program Account online via the Emirates Website under the Business Rewards page.

Termination of Membership by your organisation shall result in forfeiture of its existing Business Rewards Miles and as such your organisation will no longer be able to use these to redeem Rewards. However, termination will not effect any continuing obligations your organisation may have under these Conditions.

We reserve the right to suspend or terminate your right to earn or redeem Business Rewards Miles or suspend or terminate your Program Account at any time. We shall notify you of such termination by email sent to the email account registered in the Participant’s and Program Administrator profiles. Termination by either party will be immediate.

The Business Rewards Program may be changed, varied, suspended or terminated at any time without notice where permitted by law, save that reasonable efforts will be used to promptly post details of that change or variation, suspension or termination (as the case may be) to the Emirates Website.

Limitation Of Liability

We will not be liable for any loss, costs, damages, injuries, accidents or claims (whether direct or indirect) suffered by you, your Program Administrator, Additional Administrators or your Participants:

· in connection with the use or redemption of any Reward or the termination or suspension of your Program Account or your right to earn or redeem Business Rewards Miles;

· if, by reason of local legal or regulatory prohibitions or restrictions the Business Rewards Program or the Rewards cannot be made available in certain countries or to certain Members.

We are not responsible for any consequences resulting from Reward Flights that are disrupted, changed or cancelled, for whatever reasons, including (but not limited to) fire, flood, earthquake, windstorm or other natural disaster, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, breaking off of diplomatic relations or similar actions, terrorist attack, civil war, civil commotion or riots, nuclear, chemical or biological contamination or sonic boom, fire, explosion or accidental damage, adverse weather conditions, any labour dispute, including but not limited to strikes, industrial action or lockouts, non-performance by suppliers or subcontractors or any other circumstances beyond our control.

The limitations of liability contained in our Conditions of Carriage and website Terms and Conditions shall apply to Reward Flights.

Our liability for negligence, breach of contract or any other matter is limited to reimbursing you with Business Rewards Miles equal to those redeemed for the Reward in connection with which the matter arose.

You are solely responsible for any tax liabilities arising from your Membership including (but not limited) tax arising in connection with a Participants employment and the redemption of Rewards.

When booking services with Service Partners your contract is with the relevant Service Partners and is subject to their terms and conditions. Emirates accepts no responsibility for any loss or damage that may arise from your use of the services provided by Service Partners.

Miscellaneous

You may not assign your rights or delegate your duties without our prior written consent and any such purported assignment or delegation shall be void.

A Program Administrator may not assign his/her responsibilities to a Participant or any other third party.

The Program is governed by the laws of the Emirate of Dubai and any proceeding with respect to or in connection with Business Rewards Program must be brought in that jurisdiction.

Any provision in these Conditions which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions and any prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.

Emirates takes no responsibility for lost, delayed or mis-directed emails.
